Descriptions, Availability & Pricing

We strive for accuracy but do not warrant that product descriptions, images, or pricing are error-free, complete, or current. We reserve the right to correct errors or inaccuracies, modify pricing at any time, limit order quantities, refuse or cancel any order (including after submission), and discontinue products without notice.

Payment & Taxes

All prices are in U.S. Dollars (USD). You agree to pay all charges at the prices in effect at the time of purchase. You are responsible for all applicable taxes (including New Mexico Gross Receipts Tax where applicable), shipping fees, and customs duties.

Shipping & Risk of Loss

All shipments are made pursuant to a shipment contract. Title and risk of loss pass to you upon our delivery of the items to the carrier. Delivery timelines are estimates only and are not guaranteed.

International Orders

You are responsible for complying with all applicable laws, import restrictions, and customs requirements in the destination country.

Federal Hazardous Substances Act / CPSC

Our products are highly flammable consumer goods designed exclusively for outdoor use, including campfires, wood stoves, survival, and emergency fire-starting applications.

• Use only as directed
• Do not use indoors, inside vehicles, or in any enclosed or poorly ventilated area
• Do not use near flammable or explosive materials
• Do not use in areas subject to burn bans or fire restrictions

Improper use may result in severe burns, uncontrolled fire, property damage, serious injury, or death.

By purchasing or using our products, you acknowledge and voluntarily assume all risks associated with their use. To the fullest extent permitted by law, the Company shall not be liable for misuse, alteration, or failure to follow safety instructions.

Intellectual Property

All content on this Site—including text, graphics, logos (“Industry 51”, “Light Your Adventure”), images, product designs, and formulations—is the exclusive property of SlimJem’s Industry 51 LLC or its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, resell, or create derivative works without our prior written consent.

User Conduct

You agree to use the Site and products only for lawful purposes. You are prohibited from:

• Misusing products in a dangerous or unlawful manner

Returns, Refunds, and Limited Warranty

Your purchases are subject to our Return & Refund Policy , which is incorporated into these Terms by reference.

Limited Warranty (Magnuson-Moss Warranty Act)

We warrant that our products will be free from manufacturing defects for 30 days from the original purchase date. This is a Limited Warranty. Your sole and exclusive remedy is limited to repair, replacement, or refund (at our sole discretion). Shipping and handling costs are excluded.

THIS IS THE SOLE WARRANTY PROVIDED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

To the fullest extent permitted by law (including New Mexico law), SlimJem’s Industry 51 shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, property damage, or personal injury—arising out of or related to your use or misuse of the Site or products, even if advised of the possibility.

Our total aggregate liability shall not exceed the amount you paid for the specific product at issue.

Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, liabilities, costs, or expenses (including attorneys’ fees) arising from your misuse of products, your violation of these Terms, or your violation of any applicable law or third-party rights.

Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect and use personal information.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.

Jurisdiction

All legal actions must be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico. You consent to the personal jurisdiction and venue of those courts.

Arbitration

At our sole discretion, disputes may be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules (except where prohibited by law).

Class Action Waiver

To the fullest extent permitted by law, all claims must be brought individually and not as part of any class, collective, or representative action.

Miscellaneous

• Severability: If any provision is deemed invalid, the remainder remains enforceable.
• No Waiver: Failure to enforce a provision does not waive future enforcement.
• Force Majeure: We are not liable for delays caused by events beyond our reasonable control.
• Entire Agreement: These Terms, along with referenced policies, constitute the full agreement between you and the Company.
